RhotKing LLC – Terms of Service

1. Agreement to Terms

By accessing or using www.rhotkingcarrental.com (“Website”), you acknowledge and agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must immediately discontinue use.

These Terms govern all services, communication, agreements, and business activities between RhotKing LLC (“RhotKing,” “we,” “us,” “our”) and any vehicle owners, partners, contractors, or users.

2. Description of Services

RhotKing LLC provides fleet management, vehicle hosting, listing support, guest communication, pricing optimization, photo management, and payout processing through approved third-party platforms.

RhotKing LLC is not a bank, insurer, or guarantor of earnings. Any income examples are estimates only and not guaranteed.

3. Partner Eligibility and Obligations

Partners must:

• Own the vehicle or be legally authorized to manage it.
• Maintain active registration, valid insurance, and financing.
• List RhotKing LLC as additional interest on insurance policies.
• Remit monthly car payments through Relay or approved processors.
• Maintain vehicle cleanliness and safe operating condition.

Partners acknowledge that RhotKing’s ability to perform services depends on accurate, timely partner cooperation and compliance.

4. Earnings, Payments, and Fees

Unless otherwise agreed in writing:

• Profit split is 70/30 (Partner/RhotKing) during the first year.
• Profit split is 60/40 (Partner/RhotKing) thereafter.
• All payouts occur in USD via third-party payment processors.

Fees may apply for late documentation, emergency situations, or special requests. No level of earnings is guaranteed; results may vary based on demand, marketplace rules, seasonality, and vehicle performance.

5. Insurance and Risk Management

Each vehicle must maintain an active, rental-approved insurance policy, with RhotKing LLC listed as additional interest or operator.

RhotKing LLC may recommend insurance providers for convenience but does not sell or issue insurance. Partners are responsible for all deductibles, policy terms, and insurance-related costs.

Any lapse in insurance coverage may result in immediate suspension or termination of the partnership.

6. Maintenance, Repairs, and Damage

Partners are responsible for:

• Maintaining the vehicle in safe, legal, and reliable condition.
• Approving or declining repairs in a timely manner.
• Covering routine maintenance costs unless otherwise agreed.

RhotKing may, as a courtesy, coordinate or schedule repairs. RhotKing is not financially responsible for repairs unless explicitly agreed in writing.

7. Liability and Limitation of Damages

RhotKing LLC is not liable for any indirect, incidental, punitive, or consequential damages, including but not limited to lost income, lost bookings, or vehicle downtime.

Partners agree to indemnify and hold RhotKing LLC harmless from all claims, losses, damages, liabilities, or expenses arising from:

• Vehicle use, misuse, or operation;
• Third-party incidents or guest behavior;
• Insurance claims, denials, or disputes;
• Failure to maintain the vehicle or comply with law.

8. Termination

Either party may terminate the relationship with written notice.

Upon termination, all outstanding balances must be settled within 14 business days, and RhotKing will complete any ongoing trips before finalizing termination where reasonably possible.

RhotKing may terminate immediately in cases of fraud, insurance lapse, misrepresentation, safety concerns, or violation of these Terms.

9. Intellectual Property Rights

A. Ownership

All content on this Website—including but not limited to text, graphics, vehicle photos, logos, the gold torch branding, layouts, workflows, documents, and all digital materials—is the exclusive property of RhotKing LLC and is protected under United States copyright, trademark, and other intellectual property laws.

B. Prohibited Use

You may not:

• Copy, reproduce, republish, or mirror any Website content;
• Scrape data, clone pages, or use automated extraction tools;
• Recreate or imitate RhotKing’s branding or business model;
• Use any Website content in a competing service or product;
• Reverse-engineer workflows, systems, or proprietary structures.

C. Partner-Specific Image Use

Partners who own the vehicles enrolled with RhotKing LLC may take photos only of the vehicle they personally own. However, all edited, enhanced, listing, or marketing images produced or managed by RhotKing LLC remain the exclusive property of RhotKing LLC.

Unless you are a partner photographing your own vehicle, you are not permitted to capture, copy, download, or reuse any images from this Website or any RhotKing digital platform. Even if you are a partner, RhotKing retains ownership and licensing control over all edited or enhanced media created under the RhotKing management program.

D. Enforcement

Unauthorized use of RhotKing’s intellectual property—including brand elements, processes, media, or written materials—may result in DMCA takedown requests, civil damages, and legal action.

10. Proprietary Business Model Protection

RhotKing LLC’s operational workflows, vehicle-management systems, payout structures, communication templates, partner onboarding processes, and related methods are proprietary trade secrets. Any attempt to replicate, imitate, or resell these processes, in whole or in part, is strictly prohibited and legally enforceable.

11. Website Use Restrictions

Users are prohibited from attempting unauthorized access to the Website or its underlying systems, running scraping or data-mining tools, reverse engineering site functionality, or otherwise copying or cloning Website features.

Suspicious or abusive activity may result in IP blocking, account restrictions, or legal enforcement.

12. Data Privacy

By using this Website, you waive any right to a jury trial or participation in class actions or class arbitrations.
