RhotKing LLC — Terms of Service

Effective Date: November 2025

1. Agreement to Terms

By accessing or using www.rhotkingcarrental.com (“Website”), operated by RhotKing LLC (“RhotKing,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, discontinue use immediately. These Terms govern all services, communications, and agreements between RhotKing LLC and vehicle owners, partners, or users.

2. Description of Services

Fleet management, vehicle hosting, and partnership services;
Listing management on platforms or private channels; guest communication; scheduling; pricing optimization;
Coordination of cleaning, delivery, and maintenance;
Processing partnership-related earnings and documentation.

RhotKing acts solely as a management and facilitation service; it is not a financial institution, insurer, or guarantor of earnings.

3. Partner Eligibility and Obligations

Be the legal owner or authorized titleholder of listed vehicles;
Maintain valid registration, financing, and insurance (listing RhotKing LLC as additional interest or operator);
Provide accurate, up-to-date information;
Use Relay or another approved method to remit RhotKing’s share of profits monthly;
Notify RhotKing promptly of accidents, repairs, or material changes to coverage or title.

4. Earnings, Payments, and Fees

Year 1: Partner 70% / RhotKing 30%;
After 12 months: Partner 60% / RhotKing 40%;
Payments are made in USD through approved third-party processors; bank or processor delays are outside RhotKing’s control;
No earnings or utilization rates are guaranteed; results vary by demand, market, and vehicle performance.

5. Insurance and Risk Management

Each vehicle must be insured by the Partner at all times with RhotKing LLC listed as an additional interest or operator;
RhotKing recommends Roamly Insurance (www.roamly.com) for rental-approved, cost-efficient coverage;
RhotKing LLC does not sell or issue insurance; coverage terms, deductibles, and exclusions are governed by the issuing insurer’s policy.

6. Liability and Limitation of Damages

RhotKing LLC is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, business interruption, or vehicle downtime;
Partners agree to indemnify and hold harmless RhotKing LLC from claims, losses, liabilities, and expenses related to vehicle ownership, operation, or third-party use;
Insurance decisions and outcomes are subject to third-party provider policies and limitations.

7. Maintenance and Repairs

Partners must maintain vehicles in safe, operable condition. RhotKing may coordinate maintenance or repairs but is not obligated to fund or reimburse costs unless explicitly stated in a signed partnership agreement.

8. Termination of Agreement

Either party may terminate with written notice;
Outstanding payments or balances must be settled within 14 business days after termination;
RhotKing may terminate immediately for breach, false statements, lapse of coverage, or failure to maintain financing.

9. Intellectual Property Rights

All Website content (text, graphics, design, branding) is owned by RhotKing LLC and protected by law. Unauthorized reproduction or distribution is prohibited without written permission.

10. Privacy and Data Collection

By using this Website, you consent to the collection and processing of personal data per our Privacy Policy.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of North Carolina;
Disputes shall be resolved by binding arbitration in Mecklenburg County, NC;
Each party waives the right to a jury trial and to participate in a class action.

12. Modifications to Terms

RhotKing LLC may modify or update these Terms at any time without prior notice. Continued use after updates constitutes acceptance of the revised Terms.
